Terms and Conditions

1. Agreement to these terms

By accessing or using ThinkHub ("the platform") at mythinkhub.app, or by creating an account or signing in, you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree, do not use the platform.

If you use ThinkHub on behalf of a school, university, or other organisation, you confirm that you have authority to accept these terms for that organisation where relevant.

2. The service

ThinkHub is an educational platform that may include live and asynchronous quizzes, surveys, ThinkHub Pools, flashcards, labs, blogs, Q&A, mentoring features, and related tools. Features available to you depend on your role (for example student, teacher, mentor, or admin) and any approval or institutional arrangements that apply.

3. Eligibility and accounts

• You must provide accurate registration information and keep your login details confidential.
• You are responsible for activity under your account. Notify us promptly if you suspect unauthorised access.
• Teacher accounts may require administrator approval before sign-in is permitted.
• If you are under 18, you should only use ThinkHub with appropriate parental/guardian consent or through your school or institution, as applicable.
• You may delete your account in Settings where that feature is available. Deletion is permanent for data held in active systems, subject to our Privacy Policy and any legal retention needs.

4. User responsibility for content

You are solely responsible for all content you add, create, or publish on the platform. This includes but is not limited to:

• Quiz questions, answers, and explanations
• ThinkHub Pool prompts and responses
• Blog posts, comments, and likes
• Q&A questions, answers, and comments
• Flashcard content, course names, lab materials, and any other text or materials you submit

You represent that you have the right to post such content and that it does not violate any law or third-party rights (including intellectual property, privacy, and confidentiality). You are responsible for ensuring that your content is accurate, appropriate for an educational context, and not harmful, offensive, or misleading.

5. Acceptable use

You agree not to use the platform to:

• Post content that is illegal, defamatory, harassing, discriminatory, or otherwise objectionable
• Impersonate others or misrepresent your identity or affiliation
• Attempt to gain unauthorised access to accounts, systems, or data
• Interfere with or disrupt the platform or other users' use of it
• Upload malware or attempt to probe, scan, or reverse-engineer the service except as allowed by law
• Use the platform for commercial purposes not permitted by your institution or by us
• Collect or process other users' personal data unlawfully or outside the purposes of the service

We may remove content that we believe violates these terms or harms the community, and may suspend or terminate accounts for serious or repeated breaches.

6. Licence to use your content

You retain ownership of content you submit. You grant ThinkHub a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and process that content as needed to operate, secure, and improve the service (for example showing questions in quizzes, displaying blog posts, and storing answers). This licence ends when your content is deleted from the platform, except for residual copies retained for backups, legal compliance, or dispute resolution for a limited period.

7. Our intellectual property

The ThinkHub name, branding, software, design, and documentation are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works from the platform except as expressly permitted by these terms or by law.

8. Privacy and data protection

How we process personal data is described in our Privacy Policy, which forms part of your agreement with us. You must not use ThinkHub in a way that causes us or others to breach UK data protection law. Teachers and institutions remain responsible for their own compliance when using ThinkHub with learners (including transparency to learners and any local policies).

9. Availability and changes

We aim to keep ThinkHub available and useful, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features, or update these terms, from time to time. Where changes to these terms are material, we may provide notice on the platform or by email. Continued use after changes take effect constitutes acceptance of the updated terms, except where mandatory law requires a different process.

10. Disclaimer

The platform is provided on an "as is" and "as available" basis to the fullest extent permitted by law. Content on the platform (including user-generated content) is not necessarily reviewed by us; we are not responsible for the accuracy or legality of user content. Educational outcomes depend on many factors outside our control. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable UK law (including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).

11. Limitation of liability

Subject to section 10 and any non-excludable rights you have as a consumer under UK law:

• We are not liable for indirect, incidental, special, consequential, or pure economic loss, or for loss of profits, data, goodwill, or business opportunity, arising from your use of the platform or from content you or others post.
• Our total aggregate liability arising out of or in connection with your use of the platform shall not exceed the greater of (a) the amount (if any) you paid us to use the service in the twelve months before the claim, or (b) £100.

If you are a consumer in the UK, these terms do not affect your statutory rights.

12. Suspension and termination

You may stop using ThinkHub at any time and may delete your account where the feature is available. We may suspend or terminate access if you breach these terms, create risk or legal exposure for us or others, or if we discontinue the service. Provisions that by their nature should survive (including intellectual property, disclaimers, liability limits, and governing law) will survive termination.

13. Governing law and disputes

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your local courts where mandatory rules allow. Nothing in this section prevents you from raising a data protection complaint with the ICO as described in our Privacy Policy.
